Terms of Service

1. Acceptance of Terms

By accessing or using RetentionShift, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms form a legal agreement between you and E-commerce & Business Solutions Tomasz Mejer.

2. Description of Service

RetentionShift is an AI-powered customer retention analysis SaaS for eCommerce store owners. The service allows you to upload customer data, generate retention reports, and receive insights and recommendations to reduce churn and improve customer lifetime value.

3. Account Registration

To use RetentionShift, you must create an account with accurate and complete information. You must be at least 18 years old. You may not create more than one free account per person. You are responsible for maintaining the confidentiality of your account credentials.

4. Subscription Plans

RetentionShift offers the following subscription plans:

• Free — $0/month: 1 analysis per month, max 100 customers per CSV.
• Starter — $19/month: 10 analyses per month, max 1,000 customers per CSV, full history, PDF export, email support.
• Pro — $49/month: 50 analyses per month, max 3,000 customers per CSV, advanced AI recommendations, at-risk customer export, priority support.
• Agency — $199/month: 200 analyses per month, max 20,000 customers per CSV, white-label reports, API access, dedicated account manager, SLA guarantee.

Payments are processed by Stripe. Subscriptions renew monthly unless cancelled. You may cancel at any time. No refunds are provided for partial months.

5. Usage Limits

Each plan has monthly analysis limits and maximum CSV row limits, as described above. These limits are enforced automatically. If you exceed your limit, you will be prompted to upgrade to a higher plan.

6. Acceptable Use

You agree to use RetentionShift only for lawful purposes. You may not:

• Upload data you do not have the right to use or share.
• Upload customer data in violation of GDPR or other privacy laws.
• Reverse engineer, decompile, or attempt to extract the source code.
• Resell, redistribute, or sublicense the service without authorization.

7. Your Data and CSV Uploads

You retain ownership of the data you upload. By uploading a CSV, you warrant that you have the legal right to share that data and that you have a lawful basis under GDPR (or equivalent law) to process it. You are solely responsible for the content and accuracy of the data you upload.

8. AI-Generated Content

RetentionShift uses artificial intelligence to generate retention reports, recommendations, and insights. This content is provided for informational purposes only and is not professional business, legal, or financial advice. We do not guarantee the accuracy or completeness of AI-generated outputs.

9. Intellectual Property

The RetentionShift name, logo, software, design, and all related intellectual property are owned by E-commerce & Business Solutions Tomasz Mejer, NIP: 5882550365. You may not copy, modify, or use our brand assets without written permission.

10. Availability

We strive to keep RetentionShift available at all times, but we do not guarantee uninterrupted access or uptime. Maintenance windows, updates, and unexpected issues may occur from time to time.

11. Limitation of Liability

RetentionShift is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability is capped at the amount you paid for the service in the 12 months preceding the event.

12. Termination

We may suspend or terminate your account for violations of these terms. You may delete your account at any time from your account settings. Upon termination, your data will be deleted within 30 days, except where longer retention is required by law.

13. Governing Law

These Terms of Service are governed by the laws of Poland. Any disputes arising from these terms or the use of the service will be subject to the exclusive jurisdiction of the Polish courts.

14. Changes to These Terms

We may update these Terms of Service from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the service after that date means you accept the revised terms.
